xAI, the artificial intelligence venture founded by Elon Musk, has launched a federal lawsuit against its former engineer, Xuechen Li, on allegations of intellectual property theft. The lawsuit, filed on Thursday, August 28, 2025, in a California federal court, claims that Li misappropriated highly confidential trade secrets pertaining to xAI’s cutting-edge AI technologies, specifically its generative AI chatbot, Grok. These technologies are asserted by xAI to possess features superior to those currently offered by OpenAI’s ChatGPT platform.
According to the complaint, Xuechen Li, who joined xAI in 2024 and was among its first 20 employees after completing his PhD in Computer Science from Stanford, played a pivotal role in the development and training of the Grok AI model. The alleged theft occurred in July 2025, shortly after Li accepted a job offer from OpenAI. Notably, Li sold approximately $7 million worth of his xAI stock in July 2025, with some reports indicating an initial sale of $4.7 million in June and an additional $2 million in July.
xAI alleges that on July 25, 2025, the very day he received the cash proceeds from his stock sale, Li copied confidential information and trade secrets from his xAI-issued laptop to personal storage systems. He then resigned from the company three days later. The lawsuit further states that Li took ‘extensive measures’ to conceal his misconduct, including deleting his browser history and system logs, renaming files, and compressing them before uploading them to his personal device. xAI discovered Li’s actions on August 11, 2025.
During an August 14, 2025, meeting, Li reportedly admitted to stealing company files and attempting to cover his tracks. However, a subsequent investigation by xAI allegedly uncovered additional undisclosed stolen materials on his devices. xAI contends that the stolen technology could provide OpenAI with a significant competitive advantage, potentially enabling it to enhance ChatGPT with ‘more innovative AI and imaginative features.’

The company is seeking an unspecified amount of monetary damages and a restraining order to prevent Li from commencing his new role at OpenAI, which he was scheduled to start on August 19, 2025. This legal action is the latest development in the intensifying rivalry between Elon Musk and OpenAI. Earlier this week, xAI also filed a separate lawsuit against Apple and OpenAI, accusing them of illegally conspiring to monopolize the AI chatbot market on Apple devices.
