Colorado Court of Appeals Issues Warning on Generative AI Misuse in Legal Filings

TLDR: A recent Colorado Court of Appeals case, Al-Hamim v. Star Hearthstone, LLC, has set a precedent by warning lawyers and self-represented litigants about potential sanctions for the misuse of generative AI in court documents. While no sanctions were issued in this specific case, the court emphasized that future infractions will not be tolerated. Jacob Hollars, an attorney at Spencer Fane, highlighted the implications of this ruling, advising legal professionals to use AI tools responsibly and verify all generated citations.

The Colorado Court of Appeals has issued a significant warning regarding the use of generative artificial intelligence in legal proceedings, as detailed in the recent case of Al-Hamim v. Star Hearthstone, LLC. This marks the first published opinion in Colorado state courts to address the potential for sanctions against lawyers and unrepresented litigants who misuse generative AI in their filings.

In the Al-Hamim case, the pro se litigant, Al-Hamim, had his complaint dismissed by the district court. While the underlying dispute was not central to the issue of AI misuse, the appellate court examined the circumstances under which sanctions might be applied for the use of generative AI.

Jacob Hollars, an attorney at Spencer Fane, authored an article titled “You Were Warned: Colorado Court of Appeals Outlines Potential Sanctions for Misuse of Generative AI,” which delves into the implications of this ruling. Hollars emphasizes that while other jurisdictions have previously sanctioned pro se litigants for similar misuses, the Colorado Court of Appeals chose not to impose sanctions in the Al-Hamim case for several reasons.

Key factors in the court’s decision not to sanction Al-Hamim included his demonstrated contrition, a lack of prior history of filing court documents with “hallucinated” citations, and the absence of a published Colorado state court decision outlining appropriate sanctions for such violations. Crucially, the counsel for Star Hearthstone, LLC did not alert the court to the non-existent citations or request sanctions, which the court noted as a “teachable moment” for lawyers.

Despite the lack of sanctions in this instance, the Court of Appeals explicitly warned that it “will not look kindly on similar infractions in the future.” This signals a clear expectation that lawyers and self-represented parties in Colorado state courts will likely face sanctions if they use generative AI to produce work product without thoroughly verifying its citations.

Hollars’ article underscores the importance for legal professionals to regularly utilize powerful, time-saving tools, including those powered by AI, but with a critical eye. He advises that legal research software with AI-powered features can “read” briefs, identify citations, and report on their existence and accuracy. This proactive approach not only benefits lawyers and their clients but also assists judges, law clerks, and court staff by reducing the need for them to expend resources on verifying potentially hallucinated citations.

This ruling serves as a strong reminder across the country that while generative AI offers significant advantages in legal research and drafting, its output must be meticulously checked for accuracy and authenticity before being submitted to the courts. The Colorado Court of Appeals has now formally put its legal community on notice regarding the risks associated with unchecked AI use.
