Competition Commission of India Intensifies Scrutiny of AI and Agentic AI Market Dynamics

TLDR: The Competition Commission of India (CCI) is actively examining market dominance and competition issues arising from Artificial Intelligence (AI) and agentic AI systems. This ongoing initiative stems from a comprehensive market study initiated by the CCI, with a detailed report anticipated in June 2025. The study aims to understand AI ecosystems, identify potential anti-competitive practices, and assess regulatory implications.

The Competition Commission of India (CCI) is deepening its examination into the evolving landscape of market dominance, particularly focusing on the burgeoning fields of Artificial Intelligence (AI) and agentic AI. This strategic focus is part of a broader market study initiated by the fair trade watchdog to proactively address potential competition concerns in these rapidly advancing technological domains.

The CCI’s comprehensive market study on AI and competition is expected to culminate in a detailed report, which sources indicate is slated for release in June 2025. This study, for which the Management Development Institute Society (MDIS) was engaged following a Request for Proposal in April 2024 and an agreement signed on September 9, 2024, aims to provide an in-depth understanding of the AI ecosystem in India.

Key objectives of the study include understanding various AI systems and their associated markets or ecosystems, encompassing AI actors, essential inputs, value chains, market structures, and parameters of competition. Furthermore, the study is designed to identify and examine emerging and potential competition issues within these markets. It will also delve into the scope and nature of AI applications and use cases, assessing their opportunities, risks, and ramifications from a competition standpoint.

A significant aspect of the CCI’s focus is “agentic AI,” which refers to autonomous AI systems capable of performing complex, multi-step tasks and making decisions with minimal human intervention. Companies like Thinking Machines are actively developing such autonomous agentic AI systems for enterprise decision-making, highlighting the growing importance and potential market impact of this technology. The CCI’s examination will consider how such advanced AI capabilities might influence market structures, potentially leading to new forms of dominance or anti-competitive behavior.

The study also seeks to understand existing and evolving regulatory and legal frameworks governing AI systems and applications, both in India and other major jurisdictions. This holistic approach involves reaching out to all relevant stakeholders to gain a comprehensive understanding of the intersection between AI and competition. The CCI’s proactive stance underscores its commitment to fostering fair competition and protecting consumer interests in the face of transformative technological advancements.
