Legal Professionals Face Escalating AI-Related Liability Risks in Marketing and Operations

The legal industry is undergoing a transformative period, marked by a dramatic increase in the adoption of Artificial Intelligence (AI) tools, according to the 2025 Legal Industry Risk Index released by Embroker, a digital insurance company. The survey, conducted in June 2025 among 245 US-based full-time legal professionals, highlights both the opportunities and significant risks associated with this technological shift.

AI usage among legal professionals has surged from a modest 22% in 2024 to a substantial 80% in 2025. This widespread integration is being leveraged to enhance professional services, automate client support, and strengthen cybersecurity measures. However, this rapid adoption is not without its challenges.

Key concerns identified by respondents include professional liability risks due to over-reliance on AI (43%), data privacy breaches (38%), and legal/ethical issues arising from AI misuse (37%). A critical new challenge emerging is the rise of malpractice suits directly linked to the wrongful or undisclosed use of AI tools. This necessitates that firms not only address the ethical implications of AI but also ensure transparency and accuracy in its application to avoid legal repercussions and protect client interests.

Andy Lea, Chief Insurance Officer at Embroker, emphasized the urgency of proactive risk management: “Legal professionals are rapidly integrating AI into their workflows, but this surge in adoption introduces novel professional liability risks that firms must proactively manage. As the industry continues to embrace AI, it’s critical for firms to ensure they have guidelines in place to govern their AI use to minimize the potential for malpractice claims.” Lea added that increased confidence in the sector stems from firms adopting more strategic approaches to risk, utilizing insurance as a strategic asset for secure innovation and adaptation.

Externally, the top threats have also evolved, with ‘Challenges adapting to disruptive technologies (e.g., AI tools, LLMs)’ ranking as the number one external risk at 53%. This is closely followed by ‘professional liability claims, legal malpractice threats, or other litigation suits’ at 51%, underscoring the direct link between AI adoption and potential legal challenges. Cybersecurity breaches ranked third at 40%.

In response to these evolving risks, legal professionals are demonstrating a more strategic approach to insurance. Nearly half (45%) plan to expand their coverage, a significant increase from just 14% in 2024. Furthermore, 77% believe their current insurance policies would cover their greatest business risks, and more professionals are securing dedicated cyber insurance.

Despite a slight dip in overall business optimism (65% in 2025 vs. 70% in 2024), firms are increasingly viewing risk as an opportunity for growth, with 37% in 2025 (up from 18% in 2024) describing their approach as such, and 23% (up from 8% in 2024) fully embracing risk. This indicates a growing confidence in navigating potential pitfalls and leveraging risk for strategic business advancement.
