This innovative system is engineered to monitor FDA enforcement letters and leverage AI to discern emerging trends and patterns in regulatory actions. The objective is to assist drugmakers in proactively identifying and mitigating new compliance risks in their advertising campaigns.
The FDA has recently issued a significant number of ‘untitled letters,’ highlighting alleged violations of federal pharma marketing rules. This barrage of regulatory actions, which began around September 9, 2025, following a directive from President Donald Trump to curb direct-to-consumer advertising, has created a challenging landscape for pharmaceutical companies. The agency is actively redefining acceptable marketing practices across dozens of these letters, necessitating a rapid learning and adaptation process for marketers.
According to Alyson Hagert, president of digital and social media at Real Chemistry, the company had already developed an internal AI assistant to capture observations and understand FDA-published letters, thereby enhancing existing feedback loops. The recent surge in FDA enforcement prompted Real Chemistry to expand upon this internal experiment, leading to the creation of Compliance Compass. The tool reviews brand creative and assets against the enforcement trends it identifies in the FDA’s communications. For instance, the FDA has taken issue with common advertising practices such as ‘before-and-after’ visual juxtapositions that may imply unsupported efficacy, and the use of eye-catching visuals or background music that could obscure crucial information about side effects and contraindications.
