Anthropic Endorses California’s Landmark AI Transparency and Safety Bill, SB 53

In a pivotal move for artificial intelligence governance, Anthropic, a leading AI development company, has announced its official endorsement of California’s Senate Bill 53 (SB 53), also known as the Transparency in Frontier Artificial Intelligence Act (TFAIA). This legislation, championed by State Senator Scott Wiener, seeks to implement first-in-the-nation transparency and safety requirements for the world’s most powerful AI models. Anthropic’s support is particularly noteworthy as it stands in contrast to the significant pushback from many other major tech companies and industry groups.

Jack Clark, co-founder and head of policy at Anthropic, stated that the company views SB 53 as providing ‘a strong foundation to govern powerful AI systems’ through transparency. He further elaborated in a post on X, ‘We have long said we would prefer a federal standard. But in the absence of that, this creates a solid blueprint for AI governance that cannot be ignored.’ This endorsement positions Anthropic as a key advocate for proactive AI regulation.

SB 53 introduces several critical provisions designed to mitigate risks associated with advanced AI. It mandates that ‘large developers’ – defined as those training AI models on a specified amount of compute and with revenues exceeding $500 million – must ‘write, implement, comply with, and clearly and conspicuously publish on its internet website a safety and security protocol.’ These protocols are required to detail how developers will address ‘catastrophic harms,’ which the bill explicitly defines as AI-related incidents resulting in ‘more than 50 deaths or $1 billion in damages.’ The bill also defines a ‘foundation model’ as an AI model trained on a broad data set, designed for generality of output, and adaptable to a wide range of distinctive tasks.

Furthermore, the TFAIA includes robust whistleblower protections. It prohibits large developers from retaliating against employees who, in good faith, disclose information indicating catastrophic risks or misleading statements about risk management. The bill also tasks the Attorney General with establishing a mechanism for both developers and the public to report ‘critical safety incidents.’

Despite Anthropic’s endorsement, the bill faces considerable opposition. Industry giants such as Microsoft-backed OpenAI, through its chief global affairs officer Christopher Lehane, have urged California Governor Gavin Newsom to consider an AI policy more aligned with federal standards. Major tech advocacy groups, including the CTA and Chamber for Progress, have actively lobbied against SB 53. Their arguments center on concerns that the bill could ‘hinder AI innovation without improving safety’ and that its demands for ‘impractical’ and ‘speculative or unrealistic’ detailed planning for ‘every conceivable misuse scenario’ are excessive. SB 53 is a refined version of Senator Wiener’s previous AI safety bill, SB 1047, which Governor Newsom vetoed approximately one year ago, indicating the ongoing legislative challenges in this rapidly evolving sector.
